THE FOLLOWING SWEEPSTAKES IS INTENDED FOR PLAY IN THE FORTY-EIGHT (48) CONTIGUOUS UNITED STATES AND THE DISTRICT OF COLUMBIA ("D.C.") ONLY, AND SHALL ONLY BE CONSTRUED AND EVALUATED ACCORDING TO UNITED STATES LAW. DO NOT ENTER THIS SWEEPSTAKES IF YOU ARE NOT EIGHTEEN (18) YEARS OF AGE OR OLDER AND A LEGAL RESIDENT OF AND LOCATED IN ONE OF THE ELIGIBLE STATES OR D.C. AS OF DECEMBER 15, 2007.
1. NO PURCHASE NECESSARY. A PURCHASE WILL NOT IMPROVE YOUR CHANCES OF WINNING. ELIGIBILITY: This Sweepstakes begins 12/15/07 at 12:00:00 a.m. Eastern Standard Time ("EDT") (the "Entry Period") and is open to residents of the forty-eight (48) contiguous states and D.C., except for residents of Jefferson County, Kentucky, who are at least eighteen (18) years old as of 12/15/07 and the parent/legal guardian or an immediate family member of a student attending grades K-12 in a state-accredited public or private school (not home schooled). Sweepstakes Prize Winners must prove eligibility, including verification of social security number. Employees, officers and representatives of Advance Stores Company, Incorporated ("Sponsor"), Live Nation, Inc., Promotion Activators, Inc. and their affiliates, and their immediate families and household members are not eligible to participate. For purposes of these rules, immediate family member means parent, legal guardian, sibling, step-parent, step-sibling or grandparent. Sweepstakes ends 08/01/08 at 11:59:59 p.m. EST. VOID IN ALASKA; HAWAII; JEFFERSON COUNTY, KENTUCKY; AND WHERE PROHIBITED OR RESTRICTED BY LAW. Incomplete or inaccurate entry forms will be considered ineligible and void. Additional restrictions may apply. In the event that the Sweepstakes is challenged by any legal or regulatory authority, Sponsor reserves the right to discontinue or modify the Sweepstakes, or to disqualify participants residing in the affected geographic areas. In such event, Sponsor shall have no liability to any participants who are disqualified due to such an action.
2. HOW TO ENTER. You may enter online or by mail. Participants must fill out the required fields on the required Sweepstakes entry form to be eligible to win the Sweepstakes.
To enter online, go to http://www.advanceautoparts.com/monsterjam. You will be asked to provide your name, age, address, phone number, and valid e mail address. LIMIT ONE ENTRY PER PERSON/HOUSEHOLD/E-MAIL ADDRESS PER 24 HOUR PERIOD. All online entries must be received during the Entry Period. If an entrant uses multiple e-mail addresses to submit more than one online entry per 24 hour period during the Entry Period, only the first online entry for that 24 hour period will be accepted. Automated entries are prohibited, and any use of such automated devices will cause disqualification. Sponsor reserves the right at its sole discretion, to disqualify any individual (and all of his or her Sweepstakes entries) who tampers with the entry process. Sponsor reserves the right to cancel or suspend this Sweepstakes and randomly award the prizes from among all eligible entries received prior to action taken by Sponsor, should fraud, virus, bug or other causes beyond the control of Sponsor corrupt the administration, security or proper play of the Sweepstakes. Sponsor is not responsible for computer system, phone line, hardware, software or program malfunctions, or other errors failures or delays in computer transmissions or network connections that are human or technical in nature. All online entrants must have a valid e mail address.
To enter by mail, entrants must handprint or type the following information on a 3" x 5" card; your name, age, address, phone number, and valid e mail address (optional): The "Monster Size $10K" Sweepstakes, P.O. Box 8516, Prospect Hts., IL 60070. Only one mail-in entry per outer envelope is allowed. Submitted entries that are mechanically reproduced, forged, altered, or photocopied are ineligible and will be voided. To be eligible for the Sweepstakes drawing, mail-in entries must be postmarked by 08/1/08 and received by Sponsor at the mail-in address no later than 08/15/08.
Limit one entry per person/household/e-mail address per 24 hour period (regardless of entry method).
3. SWEEPSTAKES RESTRICTIONS. Sponsor reserves in its sole discretion the right to modify, cancel or suspend this Sweepstakes should infection by computer virus, fraud, technical failures, tampering, unauthorized intervention, bugs, or other causes beyond the reasonable control of Sponsor corrupt the administration, security, fairness, integrity or proper play of the Sweepstakes or for any reason Sponsor deems it necessary. Should the Sweepstakes be terminated prior to the stated expiration date, Sponsor will post a notice at http://www.advanceautoparts.com/monsterjam and conduct a random drawing from among all Eligible Entries received as of the date of termination to determine the Sweepstakes Prize winner. Sponsor is not responsible for computer system, hardware, software or program malfunction or other errors, failures, delayed computer transmissions or network connections that are human or technical in nature. In the event of a dispute regarding the identity of the person submitting an electronic entry, the entry will be deemed to be submitted by the "authorized account holder" and/or user of the e-mail address used to enter the Sweepstakes, provided that person meets all eligibility criteria set forth in the Eligibility section of these Official Rules. "Authorized Holder" shall mean the natural person assigned an e-mail address by an Internet Access provider, on-line service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Please see the website's privacy policy at http://www.advanceautoparts.com/monsterjam for details of the Sweepstakes policy regarding the personal information collected in connection with this Sweepstakes. Your information will not be shared with any third party. Entries that have been tampered with or altered are void.
4. DRAWING/ODDS. One (1) winner will be drawn at random from all eligible entries received, on or about August 15, 2008 by an independent judging organization whose decisions shall be final in all matters relating to the Sweepstakes. Odds of winning prize depend on the total number of eligible entries received.
5. PRIZES AND DONATIONS. To the winner: One (1) Prize ("Prize") of $5,000 in Advance Auto Parts Gift Cards. Approximate Retail Value ("ARV"): $5,000. To the school designated by the winner: A donation ("Donation") consisting of a one-day visit of the Grave Digger Experience along with a Grave Digger Driver and $2,000 in cash to be divided equally among the classrooms for supplies at the designated state-accredited K-12 school. ARV $5,000.00.
Unless specified otherwise by Sponsor, no cash will be awarded. Arrangements for the fulfillment of Prize will be made by Sponsor.
Total ARV of all prizes and donations: $10,000.00.
The Grave Digger Simulator school visit is subject to availability and will be scheduled on a mutually agreeable date within the time frame specified in Rule #6. The Sweepstakes Prize of $5,000 in gift cards will be delivered to the winner upon the completion of the Grave Digger Simulator's visit to the winner's designated school.
6. WINNER NOTIFICATION/PRIZE RESTRICTIONS. Winner will be notified by overnight delivery and will be required to: a) confirm identity and eligibility by signing and returning an Affidavit of Eligibility and a release of liability and publicity within twenty one (21) days of notification (first attempted delivery). If a winner is eighteen (18) years old, but considered a minor in his/her state of residence, the Sweepstakes Prize may be awarded on the minor's behalf to a parent/legal guardian of minor, who must execute and return any required documents as noted previously in these rules. b.) Within twenty one (21) days of winner notification, the governing body of the school designated by the winner must agree in writing to a half day (4 hours minimum) visit by the Grave Digger Experience and Driver to take place on school grounds no sooner than thirty (30) days or later than ninety (90) days following approval. If any potential winner cannot be contacted, is ineligible, fails to return any of the required documents all prizes and donations will be forfeited in their entirety and awarded to an alternate winner selected in a random drawing from the remaining eligible entries. If the winner's designated school agrees to a visit by the Grave Digger Experience but does not facilitate the visit, the prize will be awarded to an alternate winner. If no winner is qualified after six alternate winners are notified and/or the designated school agrees to but subsequently fails to facilitate the visit by the Grave Digger Experience, no Prize or Donation will be awarded. Entries become property of Sponsor and will not be returned. Except at Sponsor's discretion, no cash redemption, substitute, or transfer of a Sweepstakes Prize is allowed. Gift cards are subject to the restrictions and conditions specified by the issuer. In case of unavailability of any Sweepstakes Prize, Sponsor reserves the right to substitute a prize of equal or greater value. After fulfillment of the Sweepstakes Prize, all costs associated with acce pting the Sweepstakes Prize, including but not limited to federal, state and local taxes, will be the responsibility of the Sweepstakes Prize winner. Any and all applicable federal, state and local taxes as well as any expenses which are not expressly described herein are solely the responsibility of the Sweepstakes Prize winner. The school receiving the Sweepstakes Donation will be responsible for any applicable taxes. By accepting the Sweepstakes Prize, Winner grants Sponsor the right and in perpetuity to use his/her name, picture/portrait, likeness, voice, statements submitting descriptive information, and biographical information in whole or in part, as may be adapted, edited, or modified, as solely determined by Sponsor for advertising, publicity and promotional purposes in any media now known or hereafter discovered, worldwide, and on the World Wide Web, without review, notification or approval, all without further compensation or permission, except where prohibited by law. ANY VIOLATION OF THESE OFFICIAL RULES BY THE SWEEPSTAKES PRIZE WINNER (AS DETERMINED BY SPONSOR IN ITS SOLE DISCRETION) WILL RESULT IN SUCH WINNER'S DISQUALIFICATION AS WINNER OF THE SWEEPSTAKES AND ALL PRIVILEGES AS WILLNER WILL BE IMMIEDIATELY TERMINATED.
7. GENERAL CONDITIONS. All interpretations and decisions under these Official Rules by Sponsor are final. Sponsor reserves the right at its sole discretion to disqualify any individual it finds: (a) to be tampering with the entry process or the operation of the Sweepstakes or the http://www.advanceautoparts.com/monsterjam website; (b) to be acting in violation of the Official Rules; or (c) to be acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. CAUTION: ANY ATTEMPT BY A PARTICIPANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE OR TO UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSORS RESERVE THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW. THE VIRGINIA COURTS (STATE AND FEDERAL) SHALL HAVE SOLE JURISDICTION OF ANY OF THE CONTROVERSY REGARDING THE SWEEPSTAKES, AND THE LAWS OF THE STATE OF VIRGINIA SHALL GOVERN THE SWEEPSTAKES. EACH ENTRANT WAIVES ANY AND ALL OBJECTIONS TO JURISDICTION AND VENUE IN THOSE COURTS AND HEREBY SUBMITS TO THE JURISDICTION OF THOSE COURTS.
8. LIMITATION ON LIABILITY/RELEASE. Sponsor is not responsible for incorrect, late, lost, misdirected, illegible, corrupted, delayed, mutilated, stolen, incomplete or postage-due entries or mail; or for any problems or technical malfunctions of any telephone network or lines, computer on-line systems, servers or providers, computer equipment, software, failure of e-mail or players on account of technical problems or traffic congestion on the Internet or at any website or combination thereof, including injury or damage to participants or to any other person's computer related to or resulting from participating or downloading materials in this Sweepstakes. AS A CONDITION OF ENTERING, ENTRANTS (OR THEIR PARENT OR LEGAL GUARDIAN IF AN ELIGIBLE MINOR) AGREE (AND AGREE TO CONFIRM IN WRITING): (A) TO RELEASE AND HOLD HARMLESS SPONSOR, ITS PARENT, AFFILIATES, SUBSIDIARIES, RETAILERS, SALES REPRESENTATIVES, DISTRIBUTORS, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS ("PROMOTION PARTIES") FROM ANY AND ALL LIABILITY FROM AND AGAINST ANY CLAIMS, DEMANDS, AND CAUSES OF ACTION FOR PERSONAL INJURY AND/OR THEFT, LOSS OR DAMAGES OF ANY KIND INCURRED ARISING OUT OF PARTICIPATION IN THIS SWEEPSTAKES OR THE AWARD, RECEIPT, POSSESSION, AND/OR USE OR MISUSE OF ANY SWEEPSTAKES PRIZE; (B) UNDER NO CIRCUMSTANCE WILL ENTRANT BE PERMITTED TO OBTAIN AWARDS FOR, AND PARTICIPANT HEREBY WAIVES ALL RIGHTS TO CLAIM, PUNITIVE, INCIDENTAL, CONSEQUENTIAL, OR ANY OTHER DAMAGES, OTHER THAN FOR ACTUAL OUT-OF-POCKET EXPENSES; (C) ALL CAUSES OF ACTION ARISING OUT OF OR CONNECTED WITH THIS SWEEPSTAKES, OR ANY PRIZE AWARDED, SHALL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION; AND (D) ANY AND ALL CLAIMS, JUDGMENTS, AND AWARD SHALL BE LIMITED TO ACTUAL OUT-OF-POCKET COSTS INCURRED, EXCLUDING ATTORNEY'S FEES AND COURT COSTS. By accepting prizes, winners agree that Promotion Parties will not be held responsible for any system damage, loss of property, accidents, injuries, or death that may occur in the receipt, awarding, use or pos sesion of a Sweepstakes Prize and/or participation in any Sweepstakes Prize related activity, including any travel related thereto. Winners acknowledge that Promotion Parties have not made nor are in any manner responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to any Sweepstakes Prize, including but not limited to its quality, mechanical condition or fitness for a particular purpose. Any and all warranties and/or guarantees on a Sweepstakes Prize (if any) are subject to the respective manufacturers' terms therefore, and winners agree to look solely to such manufacturers for any such warranty and/or guarantee. By participating in this Sweepstakes, entrants and winners agree to be bound by these rules, the decisions of Sponsor, which are final in all matters relating to this Sweepstakes, and any applicable federal, state or local laws and regulations.
9. GOVERNING LAW. All issues and questions concerning the construction, validity, interpretation and enforceability of these Sweepstakes Official Rules, or the rights and obligations of Entrant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the substantive laws of the State of Virginia without regard to conflicts of law principles. All entrants consent to the jurisdiction and venue of the state of Virginia.
10. WINNER'S LIST. To obtain the winner's name, send a self-addressed stamped envelope to Advance Auto Parts Monster Size $10K Winners List, 1851 Elmdale Avenue, Glenview, IL 60026 by October 1, 2008. Winner's list will be sent when winner has been verified and prize has been awarded. VT residents may omit return postage.
